Harry A. Valetk is Of Counsel in the International Commercial Practice Group in the New York office, where he advises clients on a wide spectrum of data privacy and security issues. His practice covers issues that range from supporting M&A transactions involving cross-border data transfers, to cyber security and data breach response, implementing cloud computing services in highly regulated entities, and other regulatory assessments. He also helps clients perform privacy risk assessments for EU Safe Harbor certifications, and works on web-based consumer protection topics, including the Children’s Online Privacy Protection Act (COPPA).
Prior to joining Baker & McKenzie, Mr. Valetk was Director of MetLife’s Global Privacy Office in New York, where he worked with business lines in more than 60 countries to protect the personal data of over 90 million customers. In this role, he led numerous strategic efforts to build out a global Privacy Risk Framework, achieve compliance with several data privacy laws, implement global training and awareness initiatives, and manage data and cyber security incidents. Previously, Mr. Valetk led the video game publishing industry’s privacy compliance efforts as the Director of Privacy Online for the Entertainment Software Rating Board. Before that, he was a trial attorney for the U.S. Department of Justice, Civil Division.
Mr. Valetk advises companies on matters including:
the design and implementation of global data privacy policies and notices, data transfer agreements, and cross-border data transfer solutions;
cross-border data transfers and other obligations applicable to a multinational’s commercial and consumer customer base;
data security incident response plans; and
data privacy and security contract negotiations when outsourcing services across multiple jurisdictions.

Mr. Valetk has written extensively on identity theft, privacy, online child safety, spam, and cyberstalking laws. His articles have been featured in publications including the Stanford Technology Law Review, The New York Law Journal, Law.com, Univision.com, and BNA Privacy & Security Law.
Mr. Valetk received his IAPP Certification (Certified Information Privacy Professional) in 2004. He is an active member of the Judiciary Committee and the Information Technology Law Committee of the New York City Bar Association. And he is Deputy Regional President for the Hispanic National Bar Association.
Awards and rankings
In 2011, Mr. Valetk was awarded the Top Lawyer Under 40 Award by the Hispanic National Bar Association for his professional achievements and commitment to public service. In 2008, he received a Fulbright Senior Specialist grant to lecture abroad on data privacy and Internet safety topics. He has also served as a guest lecturer at Oxford University’s Internet Institute. Mr. Valetk was selected to participate in Spain’s prestigious Young Hispanic Leaders Program in 2005, after which he received an honorary degree from Universidad Internacional Menendez Pelayo.

Mr. Valetk graduated cum laude from Bernard M. Baruch College, Zicklin School of Business, and received his law degree from the Benjamin N. Cardozo School of Law. Mr. Valetk is licensed to practice law in New York.
