Patent Jury Written Description Request Instructions
Patent Claim Construction and Markman Hearings
Book Publication Date:
In an effort to clarify and expedite patent trials the American Intellectual Property Law Association (AIPLA) has created templates for model jury instructions in patent cases.
This form provides a template for intructions to the jury on the written description requirement, which requires that a patent be described in sufficient detail to demonstrate that the inventor actually possessed the claimed invention at the time of filing.
