Patent Jury Damages Instructions

Description: In an effort to clarify and expedite patent trials the American Intellectual Property Law Association (AIPLA) has created templates for model jury instructions in patent cases. If a finding of infringement is made the jury must be instructed on damages. The templates included here cover methods for understanding and calculating damages such as lost profits (but for test and Panduit factors) and reasonable royalties (hypothetical negotiation method).
