Patent Jury Willful Infringement Instructions

Description: In an effort to clarify and expedite patent trials the American Intellectual Property Law Association (AIPLA) has created templates for model jury instructions in patent cases. If a patent owner claims willful infringement the jury must decide whether the defendant new of the patent and acted anyway despite a high likelihood that their actions were infringing. This form provides a template for explaining willful infringement standards to the jury.
