A carrier's liability can sometimes be extremely limited by the terms of the bill of lading.
For instance where expensive items are listed as customary freight units.
If there is a loss the shipper may wish to circumvent the carrier's limited liability by suing the carrier's subcontractors.
However, Himalaya clauses like the one included here extend the carrier's rights to its subcontractors.
